Shelta Homes and Ventures (“we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information in compliance with the Nigeria Data Protection Act 2023 (NDPA) and other applicable laws. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use Shelta. By using the Platform, you consent to the practices described in this Policy.

If you do not agree with this Policy, please do not use the Platform. We may update this Policy at any time, and we will notify you of material changes. Your continued use after changes constitutes acceptance.

We are a data controller under the NDPA. If we qualify as a data controller of major importance, we will appoint a Data Protection Officer (DPO) with expertise in data protection laws.

Automatically Collected Information

  • Usage Data: IP address, browser type, device information, pages visited, time spent on the Platform, and interactions (e.g., searches, matches).
  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to track user activity, personalize content, and analyze trends. You can manage cookies via your browser settings.
  • Location Data: If enabled, we may collect approximate location to improve search results or matching.

Information from Third Parties

  • Data from social media logins (if you connect your account).
  • Information from partners (e.g., background check services, if integrated).

We do not knowingly collect information from children under 16 without parental consent, in line with NDPA requirements. If we learn we have such information, we will delete it.

How We Use Your Information

We use your information on lawful bases under the NDPA, such as consent, contract performance, legitimate interests, or legal obligations, to:

  • Provide and improve the Platform's services, including facilitating accommodation searches, listings, and roommate matches.
  • Personalize your experience (e.g., tailored recommendations based on preferences).
  • Communicate with you (e.g., notifications, updates, support).
  • Process transactions.
  • Analyze usage to enhance functionality and security.
  • Comply with legal obligations, prevent fraud, and enforce our Terms.
  • For marketing purposes (e.g., sending promotional emails), with your consent where required.

For roommate matching, we use algorithms to process your stated criteria and preferences to suggest matches. We do not use sensitive data (e.g., race, religion, health) for matching unless explicitly provided and consented to by you, and only where permitted under the NDPA.

Sharing Your Information

We may share your information with:

  • Other Users: Limited information (e.g., profiles, contact details) to facilitate connections, listings, or matches. You control what is shared in your profile.
  • Service Providers: Third parties that help us operate the Platform (e.g., hosting, analytics, payment processors), bound by confidentiality and NDPA-compliant data processing agreements.
  • Legal and Safety Purposes: To comply with laws, respond to legal processes from the Nigeria Data Protection Commission (NDPC) or courts, protect rights, or prevent harm (e.g., fraud detection).
  • Business Transfers: In connection with a merger, sale, or acquisition, your information may be merger, sale, or acquisition, your information may be transferred, subject to NDPA requirements.
  • With Consent: For other purposes with your explicit consent.

We do not sell your personal information to third parties for their marketing purposes.

Data Security

We implement appropriate technical and organizational measures as required by the NDPA to ensure the confidentiality, integrity, and availability of personal data, including encryption, access controls, and regular audits. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for securing your Account and devices. In the event of a data breach, we will notify affected individuals and the NDPC as required under the NDPA.

Your Rights and Choices

Under the NDPA, you have rights including:

  • Right to be informed about data processing.
  • Right to access your personal information.
  • Right to rectification of inaccurate data.
  • Right to erasure (right to be forgotten) in certain circumstances.
  • Right to restrict processing.
  • Right to data portability.
  • Right to object to processing, including for direct marketing.
  • Right not to be subject to automated decision-making that produces legal effects.

For cookies, use your browser's settings. You can withdraw consent at any time, though this may affect Platform functionality.

International Data Transfers

Your information may be processed in countries outside Nigeria. For transfers to countries without an NDPC adequacy decision, we ensure appropriate safeguards, such as standard data protection clauses or binding corporate rules, in compliance with the NDPA.

Data Retention

We retain your information as long as necessary for the purposes outlined in this Policy, or as required by law (e.g., NDPA retention guidelines). For example, Account information is kept while active, and usage data may be anonymized for analytics. Upon request or when no longer needed, we will securely delete or anonymize data.

Third-Party Practices

The Platform may link to third-party sites or services. Their privacy practices are not covered by this Policy. Review their policies before providing information. We ensure third-party processors comply with NDPA where applicable.

Changes to This Policy

We may update this Policy to reflect changes in our practices or legal requirements, such as NDPA amendments. We will post the updated version on the Platform and indicate the “Last Updated” date.
